Terms & Conditions of Business

1. The terms set out below constitute a contract for services between LB Educations Services Ltd and the Temporary worker and govern each and every assignment unless written agreement is provided by LB Educations to the contrary.
No contact shall exist between Lb Education and the Temporary worker between assignments. For the avoidance of doubt, these terms shall not give rise to a contract of employment between Lb Education and the Temporary worker.

2. LB Education agrees to offer the Temporary worker opportunities to work as a Supply Teacher where there are suitable assignments with a school, requiring such a temporary worker.

The temporary worker agrees that suitability shall be determined solely by LB Education; and that LB Education shall incur no liability to the Temporary worker should it fail to offer opportunities to work in the above category.

If during the course of an assignment or within 2 terms after the end of an assignment the Client wishes to employ the temporary worker direct, the temporary worker acknowledges that LB Education will be entitled either to charge the client an introduction fee or to agree and extension of the hiring period with the Client at the end of which the Temporary worker may be employed direct by the client without further charge to the client.

The Temporary worker is not to accept direct offers of work from a school where LB Education made the introduction, without prior written permission from LB Education.

3. LB Education shall pay to the temporary worker remuneration calculated at a half-day or full day, to be paid monthly in arrears, this rate will be no less than the National Minimum Wage as per the National minimal wage act 1988 as amended by such later regulations. The actual rate will be notified on a per assignment basis. This is subject to deductions in respect of PAYE and national insurance contributions and any other deductions, which LB Education may be required to make by law.
Subject to any statutory entitlement under the relevant legislation, the temporary worker is not entitled to receive payment Education or Clients for time not spent on assignment, whether in respect of holidays, illness or absence for any other reason unless otherwise engaged.

4. Under the Working time Regulations 1998 the temporary Worker accepts that daily payment is enhanced to take into account statutory holiday entitlement. All entitlement to leave must be taken during the course of the leave year in which it accrues and none may be carried forward to the following year. In addition accrued holiday pay is only to be taken during the school holidays. The holiday leave year commences on the 1 September.

None of the provisions of this clause regarding the statutory entitlement to paid leave shall affect the temporary worker status as a self-employed worker.

5. The temporary Worker may be eligible for Statutory Sick pay provided that all relevant statutory criteria are met.

6. At the end of each week of an Assignment the temporary worker shall deliver to LB Education time sheets duly completed to indicate the number of days or half days worked during the preceding week and signed by an authorised representative of the client. Failure to submit all time sheets by 4 days after month end may delay payment.

7. The Temporary worker is not obliged to accept any assignment offered, but in so doing, during every assignment and afterwards where appropriate, will:

a) Co-operate with the clients reasonable instructions and accept the direction, supervision and control of any responsible person in the client’s organisation;
b) Observe any relevant rules and regulations of the clients establishment to which attention has been drawn or which the temporary worker might reasonably be expected to ascertain.
c) Take all reasonable steps to safeguard their own health and safety and that of any other person who my be present or be affected by their actions on the assignment and comply with the Health and safety policies ad procedures of the client;
d) Not engage in any conduct detrimental to the interests of the client
e) Not at any time divulge to any person, nor use for their own or any other persons benefit any confidential information relating to the clients employment business.

8. If the temporary worker is unable for any reason to attend work during the course of an assignment the Temporary worker should inform LB Education prior to the commencement of the assignment, or day thereof.

9. LB Education or the client may, without prior notice or liability, terminate the temporary workers assignment at any time.

The temporary worker may terminate an assignment at any time without prior notice or liability.

10. These terms are governed by the law of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales

11. Enhanced disclosures will be requested from the Criminal Records Bureau.
