2. Information you must and must not disclose

Because the education roles for which this form is used are exempt from the Rehabilitation of Offenders Act 1974, you must disclose convictions and cautions that Class People is legally entitled to ask about, whether spent or unspent.

You must not disclose a protected conviction or caution that is subject to the DBS filtering rules. Youth cautions, reprimands and warnings do not need to be disclosed.

Fair assessment: A conviction, caution or other disclosure will not automatically prevent you from being registered or offered work. Class People will assess relevant information fairly, individually and in accordance with its Recruitment of Ex-Offenders Policy.

4. Ongoing notification obligation

You must notify Class People immediately if, after the date of your most recent DBS certificate or Update Service check, you become subject to any investigation or prosecution relating to a criminal act, or any matter that could lead to a conviction or police caution. This obligation continues for as long as you remain registered with or are supplied by Class People.

You must also notify Class People immediately of any arrest, charge, caution or conviction, or any other criminal matter that may affect your suitability to work with children or in an education setting.

5. Data protection

LB Education Services Ltd trading as Class People is the data controller. Class People processes criminal offence data only where lawful and necessary for safeguarding, education recruitment, DBS checks, regulated activity and legal or regulatory compliance, and applies appropriate safeguards under the UK GDPR and Data Protection Act 2018.

Information may be shared with prospective or current client schools or settings, the DBS, regulators, law-enforcement bodies or professional advisers where lawful, necessary, relevant and proportionate. It will be stored securely and retained in accordance with the Class People Privacy Notice, Data Protection Policy and Data Retention Policy.

6. Candidate declaration

I declare that the information I have provided is complete and accurate to the best of my knowledge and belief. I understand that I am not required to disclose protected convictions or cautions. I understand and accept the ongoing notification obligation above.

I understand that failure to disclose relevant information, or failure to notify Class People of a later relevant matter, may result in suspension from assignments, removal from the Class People register or termination of an assignment, subject to a fair and proportionate assessment.
